TERMS AND CONDITIONS OF SALE

ARTICLE 1: SCOPE

  www.lilipinso.comis an e-commerce site operated by the company KID KONNECT, SARL with a capital of €12,000, whose registered office is located at 270 chemin des oliviers - 34400 Lunel, registered with the Montpellier Trade and Companies Register under number 981 797 400.
These general terms and conditions of sale (accessible to the Client on the "www.lilipinso.com" website) apply to all orders placed with LILIPINSO for all items and services offered on the website www.lilipinso.com by non-commercial natural persons. Consequently, the fact that any person orders a product offered for sale on the LILIPINSO website implies full and complete acceptance of these general terms and conditions of sale, which the Customer acknowledges having read prior to placing his order after having ticked the box "I accept the General Terms and Conditions of Sale".

LILIPINSO reserves the right to modify these General Terms and Conditions of Sale at any time. Nevertheless, the General Terms and Conditions of Sale applicable to an order placed by a Customer on the LILIPINSO Site are those accepted by the Customer when placing the order.
The User may save or print these general terms and conditions of sale, provided that they are not modified.

ARTICLE 2: PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by LILIPINSO to the Customer, from order to delivery, including payment and use of services made available by LILIPINSO.

ARTICLE 3: INFORMATION ABOUT THE SELLER

The contact details of LILIPINSO (hereinafter the "Seller") are as follows:
KID KONNECT, SARL with capital of €12,000, headquartered at 270 chemin des oliviers - 34400 Lunel, registered in the Montpellier Trade and Companies Register under number 981 797 400.

In accordance with the French Data Protection Act of January 6, 1978, reinforced and supplemented by the RGPD (General Data Protection Regulation) which came into force on May 25, 2018, the Customer has, at any time, as will be indicated below, a right of access, rectification, opposition, deletion and portability of all his personal data by writing, by post and proving his identity, to the Seller's address, mentioned above.
It is specified that a minor may consent alone to the processing of personal data concerning the direct offer of information society services from the age of fifteen. For minors under the age of fifteen, double consent is required: that of the minor and that of the guardian holding parental authority. Confirmation of the order by the Customer implies unreserved acceptance of these General Terms and Conditions of Sale.
The Customer acknowledges that he/she has the capacity required to contract and purchase the Products offered on the website " www.lilipinso.com ".

ARTICLE 4: ORDER

4.1 All Clients declare that they have the capacity to enter into a contract under the conditions described below, i.e. that they are an emancipated minor or that they are of legal age and that they are not protected within the meaning of Article 488 of the Civil Code.
LILIPINSO reserves the right to refuse any Order from a Client with whom a dispute exists or arises during the processing of an Order, in particular a payment dispute

4.2 These Terms and Conditions can be read directly on the www.lilipinso.com website or at the Client's request, they can also be sent by email. The fact that the Client ticks the box "I accept the general terms and conditions of sale", before proceeding with the secure payment, constitutes an irrevocable acceptance which can only be called into question in the cases exhaustively provided for in these general terms and conditions of sale under the paragraph "right of withdrawal". The Client acknowledges by this act that he has read and understood these Terms and Conditions and accepts them.
Purchase by telephone also implies acceptance of these Terms and Conditions which they acknowledge having previously read, understood and accepted in the above-mentioned conditions.

4.3 The Customer can place his order with LA MARQUE LILIPINSO via the Internet 24 hours a day, 7 days a week. The ordering process consists of 6 successive steps. Once the selection of products has been made, and the basket has been validated, the Customer must:
  • identify selected products with options,
  • indicate quantities requested,
  • log in with your email address and password,
  • indicate the information required for delivery. A precise delivery address with a cell phone number, as well as any accessibility restrictions to the delivery location (building, floor, keypad, etc.),
  • indicate the delivery method chosen,
  • indicate method of payment.
Once the method of payment has been selected, the Customer must proceed with the payment of his/her order on the secure interface, which will formalize in a firm and definitive manner the sales contract binding him/her to KID KONNECT.
Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will be settled within the framework of a possible exchange and the guarantees mentioned below.
In all cases, the final validation of the order by the Customer shall constitute proof of the order and payment of the sums for the products selected in the order. This validation constitutes signature and acceptance of all operations carried out on the LILIPINSO.com website.

ARTICLE 5: ORDER CONFIRMATION

An email is automatically sent to the customer to confirm the order taken, provided that the email address indicated in the registration form does not contain any errors.
The Client must verify the completeness and conformity of the information it provides to KID KONNECT. The latter cannot be held responsible for any input errors and the consequences in terms of delay or error in delivery. In this context, all costs incurred for reshipment will be borne by the Customer.

ARTICLE 6: MODIFICATION OF THE ORDER

Once confirmed and accepted by the Seller (KID KONNECT), under the conditions described above, the order cannot be modified.

ARTICLE 7: ORDER CANCELLATION
Once confirmed and accepted by the Vendor, under the conditions described above, the order cannot be cancelled, except in the event of the exercise of the right of withdrawal or force majeure.

ARTICLE 8: ORDER TRACKING
The customer can check the status of his order at any time by consulting the section "My Account on the LILIPINSO.com website. This tracking system enables the customer to find out the status of his order, as well as the shipping status of his parcels. The latter is done by interfacing with the carriers' Internet tracking systems. KID KONNECT cannot therefore be held responsible for any unavailability or errors that may affect the information provided by its carriers. KID KONNECT nevertheless strives to make this information as clear as possible, and to ensure that transport with its carriers is as reliable as possible. The customer may at any time contact the customer service department of KID KONNECT to keep track of your order.

ARTICLE 9: PRODUCT INFORMATION
The Products offered for sale are those that appear on the "www.lilipinso.com" website. The list of Products is subject to change and may be updated according to the Products offered and the stocks available under the conditions defined below.

The Client is required to familiarise himself with the Products offered before placing an order. The choice and purchase of a Product is the sole responsibility of the Customer.
The information, characteristics, photographs and graphics presented on the websites or in the emails sent by the LILIPINSO BRAND are presented with the greatest possible accuracy. Each Product sheet is written from the information provided by the manufacturer or supplier of the Product, and presents the essential characteristics of the Product selected in accordance with Article L.111-1 of the Consumer Code.
This information is intended, without being exhaustive, to inform the Customer as fully as possible about the essential characteristics of the Products.
The Client is informed, without prejudice to its rights, of the possibility of a difference in presentation at Delivery resulting from a change in packaging (photograph and illustrations) by the manufacturer or supplier, which difference does not affect in any way the content and characteristics of the Product.
It is therefore understood that the photographs presented on the "www.lilipinso.com" Website are non-contractual and cannot engage the Seller's liability.
The Client is required to refer to the description of each Product in order to know its properties, essential features and delivery times.
The contractual information is presented in French and is confirmed at the latest at the time of validation of the order by the Client.
The Products presented on the "www.lilipinso.com" website are offered for sale via an e-commerce ordering process, without geographical limitation.
However, deliveries of Products are only made to the countries indicated in the article "DELIVERY / DELIVERY AREAS" below. In the event of an order to a country other than mainland France, the Client is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice. Customs or other local taxes or import duties or state taxes may be payable. They will be the responsibility and sole responsibility of the Client.
KID KONNECT undertakes to honour orders received only within the limits of available stocks of products or within the limits of stocks available from its suppliers. In the absence of availability of the Product(s), KID KONNECT undertakes to inform the Customer as soon as possible. KID KONNECT reserves the right to modify the product assortment, in particular according to the constraints imposed by its suppliers.

Availability may vary on the same day depending on sales levels.  KID KONNECT frequently updates availability. In case of product unavailability, KID KONNECT will notify the Customer by e-mail.
Product unavailability is indicated on the product page and in the basket summary. In this way, Products may appear with a shipping lead time such as "in stock" or "immediate", "4 to 8 days", "1 to 2 weeks", "4 to 6 weeks", "Product not available", etc.
The delivery times indicated in the description sheets are indicative when the product(s) is (are) not available in stock. The customer will be informed by LA MARQUE LILIPINSO in its order tracking system in the event of a slight delay, or by e-mail in the event of a prolonged delay.
If KID KONNECT cannot obtain a product ordered from its suppliers, the company will notify the customer of the expected delay by e-mail. The customer may then request reimbursement of the sums paid within 14 days of their payment, or exchange the unavailable product for another, or cancel the order. No cancellation penalty will be applied to such an order cancellation. No compensation for cancellation (apart from full reimbursement of the Order) may also be claimed, such unavailability resulting from the time required to update such unavailability.

KID KONNECT shall not be held liable for breach of contract in the event of product shortage or unavailability, force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications, flooding or fire.

ARTICLE 10: PRICES

Prices are indicated in euros including all taxes and are only applicable on the date of dispatch of the order by the Customer.
As the prices of LILIPINSO's suppliers are constantly changing, the prices displayed on the website are subject to change at any time.
Prices do not take into account delivery costs, gift wrapping costs, any promotional offers and personal discounts, indicated before the final validation of the order.
Prices take into account the VAT applicable on the day of the order and any change in the legal VAT rate will be automatically reflected in the price of the products presented on the site, on the date stipulated by the implementing decree.
However, the prices cannot be changed once the Customer's order has been placed. Similarly, if one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change may be reflected in the sale price of the items on the LILIPINSO.com site.

ARTICLE 11: PAYMENT
11.1 Means of payment
The customer may pay for his order online by credit card (Carte Bleue, Visa, Eurocard-Mastercard) or by PayPal or bank transfer. The customer guarantees the company KID KONNECT that he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order.
Payment by credit card is irrevocable, except in the event of fraudulent use of the card. In this case, the customer may request the cancellation of the payment and the return of the corresponding sums.
KID KONNECT uses all necessary means to ensure the security and confidentiality of data transmitted online. To this end, the site uses a secure SSL (Secure Socket Layer) payment method, which encrypts the customer's bank details as they are transmitted over the network. Customers can tell that the transmission is encrypted by software when the padlock symbol appears in their browser.
The company KID KONNECT reserves the right to suspend all order processing and deliveries in the event of refusal to authorize payment by credit card by officially accredited organizations or in the event of non-payment. The company KID KONNECT notably reserves the right to refuse to make a delivery or to honour an order from a Customer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.

11.2 Invoice
The order form that the Client draws up online or the order confirmation sent by e-mail to the Client by LA MARQUE LILIPINSO does not serve as an invoice. The Client has the original invoice in his online account. The invoice is not included with the package.
KID KONNECT keeps an electronic copy of each invoice. In the case of delivery to an address other than the billing address, the invoice is in all cases only available in the online order tracking section of the customer's account.

11.3 Transfer of Ownership
KID KONNECT remains the owner of the Products delivered until full payment has been received from the Customer, regardless of the date of delivery of said Products. The above provisions do not prevent the transfer to the Customer of the risks of loss or deterioration of the Products subject to retention of title, or of any damage they may cause, as soon as the Products have been delivered.

ARTICLE 12: DELIVERY

12.1 Delivery Zones
The geographical area of delivery of the LILIPINSO store offer is as follows:
  • France and overseas departments and territories: mainland France, Corsica, Guadeloupe, French Guiana, Martinique, Monaco, New Caledonia, French Polynesia, Saint Barthélemy, Saint Martin

  • Europe: Andorra, Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Guernsey, Hungary, Canary Islands, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Sweden, United Kingdom.

  • World: Argentina, Australia, Brazil, Canada, China, Israel, Japan, Lebanon, New Zealand, Reunion, Singapore, South Korea, Switzerland, Taiwan, Turkey, USA...
The customer can contact LA MARQUE LILIPINSO's customer service department at the following coordinates, in particular to obtain more information on delivery conditions in a specific country in the world:
Orders from private customers to countries outside the European Union will be subject to French VAT, unless otherwise stipulated by applicable tax provisions, notably allowing VAT exemption for exports. In any case, these orders are also subject to any taxes and customs duties in the destination country. These costs and related formalities are the responsibility of the customer/consignee. They must be paid directly to the carrier at the time of delivery.

The customer is also responsible for checking whether the products ordered can be imported under the laws of the country of delivery. KID KONNECT recommends contacting the Customs Department for further information.

12.2 Delivery Services
Products are delivered to the address indicated by the Customer on the order form. The Customer is responsible for verifying the completeness and accuracy of the information provided to KID KONNECT. The latter cannot be held responsible for any input errors and the consequences in terms of late or incorrect delivery. In this context, all costs incurred for the reshipment of the order will be entirely at the Customer's expense.
KID KONNECT cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (including in particular in the event of a total or partial strike, in particular of postal services and means of transport and/or communications).

12.3 Shipping Time
Orders placed online at www.lilipinso.com are collected every day from Monday to Friday, except on public holidays. KID KONNECT makes every effort to process and dispatch all orders for products in stock on the same day. However, the time taken to process and prepare an order may be longer, depending on the item, and may take between 1 and 3 weeks, depending on product availability. Upon receipt of the shipment confirmation e-mail, the Customer may take into account the carrier lead times announced below.
KID KONNECT informs its Customers that these shipping times do not include Saturdays, Sundays and public holidays.
In the case of an order that includes one or more unavailable products as well as one or more available products, KID KONNECT dispatches the order as soon as it has been received. If the Customer wishes to receive immediately available Products as soon as possible, he is advised to isolate these items in a specific separate order.
An e-mail is automatically sent to the Customer when the Products are dispatched, provided that the e-mail address given in the registration form is correct.

12.4 Transportation Delays
Transport times depend on the carrier chosen by the Client and the place of delivery.
KID KONNECT informs Customers of the deadlines announced by the chosen carrier for information purposes only. Shipping costs are calculated according to the country of delivery at the time of the basket and are definitively confirmed according to the mode of transport and the delivery destination chosen, before the final validation of the order.
However, KID KONNECT informs its customers that the delivery times quoted do not include Saturdays, Sundays and public holidays.

12.6 Means of delivery in Metropolitan France
For the attention of the customer and for information purposes
Standard delivery by Colissimo : the average delivery time in France is 48-72 hours. This delivery method allows the Customer to receive their parcel within 48-72 hours of dispatch thanks to the Post Office and the Colissimo service. Deliveries are made from Monday to Saturday morning, except on public holidays. The cost incurred for this option depends on the weight and total volume of the items ordered.

Delivery by DPD : the average delivery time observed in France is 24-48 hours.
This delivery method allows the Customer to receive their parcel within 24-48 hours of dispatch thanks to DPD (excluding processing and preparation time for the order, which can take 1 to 2 days). Deliveries are made from Monday to Friday, except on public holidays.
The delivery times we indicate are indicative and those generally observed. No reimbursement of shipping costs will be made in the event of delivery taking longer than those indicated.

The seller ( KID KONNECT) cannot be held responsible for malfunctions or delays caused by the carrier selected by the customer to make the delivery.

12.7 Means of delivery outside metropolitan France
In Europe and abroad, delivery is made via various carriers: Colissimo and GLS. The costs incurred depend on the destination country, the weight and the total volume of the selected items. The costs and deadlines are indicated to the Client before the final validation of his order.
Orders to countries outside the European Union are subject to French VAT. However, they are subject to any taxes and customs fees of the destination country. These costs and the related formalities are borne by the customer/recipient. They are to be paid directly to the carrier upon delivery.
The customer is also responsible for checking the import possibilities of the ordered products with regard to the law of the country of delivery. We recommend contacting the Customs Service for more information.
PACKAGING
The products are packaged in such a way as to comply with current transport standards, and to ensure optimum protection of the products during delivery. The customer is asked to respect these same standards when returning a product, whether for after-sales service or for a return for convenience. In the event of a product return, if we find that the product has been returned to us damaged due to inadequate packaging, KID KONNECT may decide to refund only part of the product or refuse to refund it if it cannot be resold in its original condition.

12.8 Responsibility of the customer for the verification of parcels upon receipt
LILIPINSO reminds you that it is the Customer's responsibility to inspect his parcels upon receipt in the presence of the delivery person and to immediately notify the carrier on the delivery slip and LA MARQUE LILIPINSO's customer service department of any anomaly noted (shock, damaged parcel, etc.). In the event that such information is not included on the delivery slip presented to the customer by the carrier, no claim relating to the condition of the parcel(s) may be accepted a posteriori by LA MARQUE LILIPINSO. KID KONNECT.

12.9 Carrier-Related Delivery Delays
In the event of a delay in delivery compared to the deadlines announced by the carriers, the Customer must contact the carrier or its distribution office as a priority in the case of La Poste, to see if the package is not pending. If necessary, the Customer may contact LA MARQUE LILIPINSO Customer Service by phone or email in order to open a dispute or investigation file to carry out a search for the package.
Sometimes parcels are lost by carriers. The time limits imposed by the carriers mean that the customer must declare the loss within 10 days of receiving the dispatch notice from the carrier. KID KONNECT. Under these conditions, KID KONNECT is responsible for making the necessary claims with the carrier concerned. Once the claim and investigation have been made, it can take 3 to 4 weeks to receive a return from the carrier.
If the parcel is found, it will be returned immediately to the Customer's home address. If the parcel is not found, the Customer may request the return of the same product (within the period of availability), at the expense of KID KONNECT or a refund of the amount paid. If the product(s) ordered are no longer available at that time, KID KONNECT will reimburse the amount of the products concerned by the carrier's loss.

12.10 Damaged Packages
It is the Customer's responsibility to check the condition of the package in the presence of the carrier, and to make any necessary reservations on the delivery note in the event of partial or total deterioration. If no reservations are made, the parcel is deemed to have been accepted by the Customer and cannot be contested. The Customer must inform KID KONNECT by e-mail within 48 hours, so that we can KID KONNECT can take the necessary measures as quickly as possible.

12.11 Customer Service Notification Period
Upon receipt of the package, the Customer has a period of 48 working hours from the date of receipt of the order to open a complaint concerning a damaged package, a missing product or any other problem with customer service.

ARTICLE 13: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE
13.1 Right of withdrawal 
In accordance with the legal provisions in force, the Customer has a period of FOURTEEN (14) days from receipt of the Product to exercise its right of withdrawal from the Seller, without having to give any reason or pay any penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within FOURTEEN (14) days at the latest following notification to the Vendor of the Customer's decision to withdraw.

Returns must be made in their original, complete condition (packaging, accessories, instructions where applicable, etc.) to enable them to be remarketed as new, accompanied by the purchase invoice.

Damaged, soiled or incomplete Products will not be taken back and the Customer will not be reimbursed for the price paid.

The right of withdrawal may be exercised by the Customer by means of the form provided for in the article "Methods of exercising the right of withdrawal" below, which the Customer must send to the Vendor under the conditions stipulated therein.
If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs will be reimbursed, with the cost of returning the Product(s) remaining at the Customer's expense.

Refunds will be made as soon as possible and no later than FOURTEEN (14) days upon receipt by KID KONNECT of the goods returned by the Customer to the address indicated on the return form. When the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

The refund will be made by the same means of payment as that used by the Customer for the initial transaction, unless the Customer specifically requests a credit note, valid for six (6) months from the date of issue. Refunds will be made as soon as possible and no later than
In accordance with article L.221-23 of the French Consumer Code, the right is exercised by returning the Article, with only the shipping costs remaining payable by the Customer.

13.2 ARTICLES EXCLUDED FROM THE RIGHT OF WITHDRAWAL
In accordance with Article L.221-28 of the French Consumer Code, the Client does not have a right of withdrawal for the Order of Items which, due to their nature, cannot be reshipped or are likely to deteriorate or expire quickly, to return their Order. This applies in particular to goods whose original packaging has been unsealed (in particular for the purchase of paint).

13.3 PROCEDURES FOR EXERCISING THE RIGHT OF WITHDRAWAL

KID KONNECT suggests that the Customer return the products by registered post with acknowledgement of receipt or with additional insurance, guaranteeing, where applicable, compensation for the products up to their actual market value in the event of spoliation or loss of the goods. In all cases, returns are made at the customer's risk. It is the customer's responsibility to retain all proof of return. The cost of return shipment is borne by the customer, who is free to choose the method of shipment.

KID KONNECT will not be able to reimburse the Customer if the above-mentioned deadlines are not met. Only items returned in their original packaging in perfect condition for resale (cardboard backs, plastic sleeves, packaging bags rug ...) will be accepted.

Withdrawal may never be exercised if the Articles delivered have been, even partially, washed, soiled, damaged or used. Similarly, items returned incomplete, damaged or soiled by the customer will not be returned or exchanged.

The Customer may only be held liable in the event of depreciation of the Article resulting from handling other than that necessary to establish the nature, characteristics and, where applicable, the proper functioning of the Articles.
Refunds in the event of use of the right of withdrawal will be made by the same means of payment as that used by the Customer for the initial transaction, unless the Customer specifically indicates otherwise.

ARTICLE 14: GUARANTEES, CLAIMS MEDIATION

14.1 Warranty
The Products sold on the "www.lilipinso.com" website comply with the regulations in force in France and have performances compatible with non-professional uses.
Products supplied by KID KONNECT benefit from the right of withdrawal by operation of law and without further payment, in accordance with the statutory provisions :
  • the legal guarantee of conformity, for apparently defective Products or Products that do not correspond to the order, provided that the consumer can prove that the goods do not conform to the contractual stipulations / do not conform to the order,
  • the legal warranty against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use,
KID KONNECT in no way replaces the constant vigilance of adults.
The responsibility of KID KONNECT shall not be held liable in the event of failure to comply with the legislation of the country to which the products are delivered. It is the customer's responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.
14.2 Complaint/Mediation
Any complaint must be made in advance by email via the "Customer Service" section of the Site.

In order to assert its rights, the Client must inform the Seller, in writing, of the non-conformity of the Products within a maximum period of SEVEN (7)  days from the delivery of the Products or the discovery of the latent defects within the above periods referred to above and return the defective Products in the condition in which they were received with all the elements (accessories, packaging, instructions, etc.).
Seller will refund, replace, or repair any Products or parts under warranty that are found to be non-conforming or defective.
Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of supporting documents.
Refunds for Products found to be non-conforming or defective will be made as soon as possible and no later than FOURTEEN (14) days following receipt of the Article by KID KONNECT  depending on the method of payment chosen at the time of the Order, either on the bank card used for payment, or on the Customer's PayPal account, or by bank transfer. These provisions are not exclusive of the aforementioned right of withdrawal.
The Vendor cannot be held liable in the following cases:
  • non-compliance with the legislation of the country to which the products are delivered, which it is the Customer's responsibility to check,
  • in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as well as in the event of normal wear and tear of the Product, accident or force majeure.
The Vendor's warranty is, in any event, limited to the replacement or reimbursement of Products that do not conform or are defective.
The Customer is hereby informed that he may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (article L 612-1 of the French Consumer Code) or with existing sector-specific mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

ARTICLE 15: LIABILITY

The Products offered comply with current French legislation and the standards applicable in France. The responsibility of KID KONNECT shall not be held liable in the event of non-compliance with the legislation of the country to which the product is delivered. It is the customer's responsibility to check with the local authorities regarding the possibility of importing or using the products he/she intends to order.
The responsibility of KID KONNECT  shall not be held liable for any inconvenience or damage relating to the use of the Internet network, such as a break in service, the presence of computer viruses or external intrusions, and more generally for any event qualified by the courts as force majeure or the actions of third parties.
Hypertext links may lead to sites other than www.lilipinso.com. KID KONNECT declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.

ARTICLE 16: FORCE MAJEURE
Neither party will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. An act of God or force majeure shall be deemed to be any fact or circumstance which is irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonable efforts.
The Party affected by such circumstances will notify the other within ten working days of becoming aware of them.
The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue.
If the case of force majeure lasts for more than three months, the present terms and conditions may be terminated by the aggrieved party.
The following are expressly considered as cases of force majeure or fortuitous events, in addition to those generally accepted by the jurisprudence of French courts and tribunals:
  • Total or partial strikes, internal or external to the company, blockage of means of transport or supplies for any reason whatsoever, governmental or legal restrictions, computer breakdowns, earthquakes, fires, storms, floods, lightning;
  • Stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the Customer.

ARTICLE 17: PERSONAL DATA
17.1 Processing of personal data
The Sale of Products on the KID KONNECT (Vendor) involves the collection and processing of the Customer's personal data.
The Vendor specifies that the Customer's personal data (in particular names, addresses, e-mail, telephone...) will be stored under the conditions specified below.

On the basis of the regulations in force, the Seller informs the Client that his data will be recorded and processed in accordance with the provisions of the Data Protection Act n°78-17 of 6 January 1978.
The Client is therefore informed that its data will be processed in a way that allows, in general, to be able to offer the Client the Seller's Services in the context of the sale of Products.
This being specified, the processing of the Customer's personal data that will be carried out by the Seller (collection, storage, archiving, mailing, commercial mails, etc.) will have to take place in compliance with the provisions of Regulation (EU) 2016/679 - the "RGPD", as well as any other law or regulation applicable to processing with regard to the protection of personal data.

To this end, the Seller undertakes to :
  • Collect and process personal data with the prior consent of the Customer and with prior information about the use of such data;
  • Collect and process personal data for the sole purpose of storage, archiving, commercial mailings, etc;
  • Implement all technical and organizational measures, including measures adapted to the nature of the personal data collected and processed and to the risks presented by the processing. This will involve, in particular, as far as possible:
    • Data confidentiality ;
    • Restoration of data availability and access within an appropriate timeframe in the event of a physical or technical incident, insofar as this is materially and legally possible,
    • The protection of data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, in particular when data processing involves transmission over a network, as well as against any form of unlawful processing or communication to unauthorized persons.
  • To subcontract all or part of the personal data to reliable service providers;
  • To process personal data as far as possible only within the European Union;
  • To ensure that their employees, servants, agents and its authorized subcontractors or any person acting on their behalf, who have access to personal data, comply with the obligations contained herein;
  • Implement without delay any request from the Parties the rights of the persons concerned relating to the personal data processed (right to modification, correction or deletion, right of opposition, etc.);
  • Retain personal data after the end of each service/sale only for as long as is legitimate and/or required by law.
The personal data collected may not be used by the Seller for any purpose other than that of meeting the purposes described above. It may not be disclosed, transferred, rented or in any way assigned.

In the event of a change in the applicable regulations, the Seller and the Client undertake to make the necessary adaptations to comply with the new applicable provisions.

In the event of a breach of personal data or suspected personal data, the Seller and the Client undertake to keep each other informed as soon as possible following the discovery of this breach or suspected breach.
Seller and Customer may be compelled to disclose personal data at the request of a court, administrative agency, governmental authority or pursuant to any applicable law, regulation, subpoena, petition or other applicable administrative or legal process including any formal or informal investigation by a government agency or authority. In this case, the Party concerned undertakes to inform the other Party as soon as possible.

Subject to what is provided herein, any unauthorized processing, use or disclosure of personal data is strictly prohibited.
By adhering to these terms and conditions, the Client acknowledges that he or she has read the Seller's personal data protection policy and consents to the collection and use of his or her data.
17.2 Exercising rights in relation to personal data
The Seller (or its beneficiaries) has the right to access, oppose and rectify data concerning him/her, in accordance with articles 32 et seq. of the French Data Protection Act No. 78-17 of 6 January 1978.
These rights may be exercised by the Customer by sending a request either by post to the Vendor's business address at 270 chemin des Oliviers or by E-Mail: serviceclients@lilipinso.com
This request must be accompanied by a copy of an identity document bearing the applicant's signature and must specify the address to which a reply can be sent to the Customer.

ARTICLE 18: INTELLECTUAL PROPERTY
All content (text, comments, works, illustrations, images, videos, graphics, sound, etc., including the underlying technologies used) displayed on the "www.lilipinso.com" website is protected by copyright and intellectual property laws worldwide. As such, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any other use constitutes an infringement and is punishable under the Intellectual Property Code without the prior authorization of KID KONNECT. Total or partial reproduction of the company's catalog is prohibited. KID KONNECT is strictly forbidden.
Anyone with a website wishing to place a simple link directly to www.lilipinso.com must request authorization from KID KONNECT. Authorization by KID KONNECT shall in no case constitute an implicit agreement of affiliation and shall in no case be given on a definitive basis. Upon request from KID KONNECTthis link must be removed.

ARTICLE 19: FULL TERMS
A change in legislation, regulations or a court ruling rendering one or more clauses of these General Terms and Conditions of Sale null and void shall not affect the validity of these General Terms and Conditions of Sale. Such a change or finding shall in no way entitle the Customer not to comply with these General Terms and Conditions of Sale. If a condition is not explicitly mentioned, it will be considered to be governed by the practices in force in the distance-selling sector whose companies are based in France.
The relationship between the company KID KONNECT and the Customer are governed exclusively by these terms and conditions to the exclusion of any other terms and conditions appearing on the LILIPINSO.com website.

ARTICLE 20: DURATION AND APPLICATION
The present Conditions apply for the entire duration of the online services offered by the company. KID KONNECT. They can be modified at any time by KID KONNECT. The Conditions applicable are those in force on the date the order is registered.

ARTICLE 21: TERRITORIALITY AND APPLICABLE LAW
Sales of company products KID KONNECT are governed by French law. In the case of an individual Customer, any dispute relating to the existence, interpretation, performance or termination of the contract concluded between KID KONNECT and the Customer, even in the event of multiple defendants, will, in the absence of amicable agreement, be subject to the exclusive jurisdiction of the court of the Customer's domicile. In the case of a professional Customer, any dispute relating to the existence, interpretation, performance or breach of contract between KID KONNECT and the Customer, even in the event of multiple defendants, will, in the absence of amicable agreement, be subject to the exclusive jurisdiction of the courts of Montpellier.

ARTICLE 23: PRE-CONTRACTUAL INFORMATION
The fact that a person orders on the "www.lilipinso.com" website implies full and complete acceptance of these General Terms and Conditions of Sale and the obligation to pay for the Products ordered, which is expressly acknowledged by the Client, who waives, in particular, the right to invoke any contradictory document, which would be unenforceable against the Seller.
PROVISIONS OF THE CONSUMER CODE
DISTANCE AND OFF-PREMISES CONTRACTS

Article L221-1
I. - Pour l'application du présent titre, sont considérés comme :
1° Contrat à distance : tout contrat conclu entre un professionnel et un consommateur, dans le cadre d'un système organisé de vente ou de prestation de services à distance, sans la présence physique simultanée du professionnel et du consommateur, par le recours exclusif à une ou plusieurs techniques de communication à distance jusqu'à la conclusion du contrat ;
2° Contrat hors établissement : tout contrat conclu entre un professionnel et un consommateur : a) Dans un lieu qui n'est pas celui où le professionnel exerce son activité en permanence ou de manière habituelle, en la présence physique simultanée des parties, y compris à la suite d'une sollicitation ou d'une offre faite par le consommateur ;
b) Ou dans le lieu où le professionnel exerce son activité en permanence ou de manière habituelle ou au moyen d'une technique de communication à distance, immédiatement après que le consommateur a été sollicité personnellement et individuellement dans un lieu différent de celui où le professionnel exerce en permanence ou de manière habituelle son activité et où les parties étaient, physiquement et simultanément, présentes ;
c) Ou pendant une excursion organisée par le professionnel ayant pour but ou pour effet de promouvoir et de vendre des biens ou des services au consommateur ;
3° Support durable : pour l'application du chapitre Ier du présent titre, tout instrument permettant au consommateur ou au professionnel de stocker des informations qui lui sont adressées personnellement afin de pouvoir s'y reporter ultérieurement pendant un laps de temps adapté aux fins auxquelles les informations sont destinées et qui permet la reproduction à l'identique des informations stockées ;
4° Contenu numérique : des données produites et fournies sous forme numérique.
II - Les dispositions du présent titre s'appliquent aux contrats portant sur la vente d'un ou plusieurs biens, au sens de l'article 528 du code civil, et au contrat en vertu duquel le professionnel fournit ou s'engage à fournir un service au consommateur en contrepartie duquel le consommateur en paie ou s'engage à en payer le prix. Le contrat ayant pour objet à la fois la fourniture de prestation de services et la livraison de biens est assimilé à un contrat de vente.
Article L221-2
Sont exclus du champ d'application du présent chapitre :
1° Les contrats portant sur les services sociaux, y compris le logement social, l'aide à l'enfance et aux familles, à l'exception des services à la personne mentionnés à l'article L. 7231-1 du code du travail ;
2° Les contrats portant sur les services de santé fournis par des professionnels de la santé aux patients pour évaluer, maintenir ou rétablir leur état de santé, y compris la prescription, la délivrance et la fourniture de médicaments et de dispositifs médicaux ;
3° Les contrats portant sur les jeux d'argent mentionnés à l'article L. 320-1 du code de la sécurité intérieure, y compris les loteries, les jeux de casino et les transactions portant sur des paris ;
4° Les contrats portant sur les services financiers ;
5° Les contrats portant sur un forfait touristique, au sens de l'article L. 211-2 du code du tourisme ;
6° Les contrats portant sur les contrats d'utilisation de biens à temps partagé, les contrats de produits de vacances à long terme et les contrats de revente et d'échange mentionnés aux articles L. 224-69 et L. 224-70 ;
7° Les contrats rédigés par un officier public ;
8° Les contrats portant sur la fourniture de denrées alimentaires, de boissons ou d'autres biens ménagers de consommation courante, qui sont livrés physiquement par un professionnel lors de tournées fréquentes et régulières au domicile ou au lieu de résidence ou de travail du consommateur ;
9° Les contrats portant sur les services de transport de passagers, à l'exception des dispositions prévues à l'article L. 221-14 ;
10° Les contrats conclus au moyen de distributeurs automatiques ou de sites commerciaux automatisés ;
11° Les contrats conclus avec des opérateurs de télécommunications pour l'utilisation des cabines téléphoniques publiques ou aux fins d'une connexion unique par téléphone, internet ou télécopie, notamment les services et produits à valeur ajoutée accessibles par voie téléphonique ou par message textuel ;
12° Les contrats portant sur la création, l'acquisition ou le transfert de biens immobiliers ou de droits sur des biens immobiliers, la construction d'immeubles neufs, la transformation importante d'immeubles existants ou la location d'un logement à des fins résidentielles.
Article L221-3
Les dispositions des sections 2, 3, 6 du présent chapitre applicables aux relations entre consommateurs et professionnels, sont étendues aux contrats conclus hors établissement entre deux professionnels dès lors que l'objet de ces contrats n'entre pas dans le champ de l'activité principale du professionnel sollicité et que le nombre de salariés employés par celui-ci est inférieur ou égal à cinq.
Article L221-4
Les dispositions du présent chapitre s'appliquent aux contrats portant sur la fourniture d'eau, de gaz ou d'électricité lorsqu'ils ne sont pas conditionnés dans un volume délimité ou en quantité déterminée ainsi que sur la fourniture de chauffage urbain.
Elles s'appliquent également aux contrats portant sur la fourniture de contenu numérique indépendamment de tout support matériel.
Article L221-5
Préalablement à la conclusion d'un contrat de vente ou de fourniture de services, le professionnel communique au consommateur, de manière lisible et compréhensible, les informations suivantes :
1° Les informations prévues aux articles L. 111-1 et L. 111-2 ;
2° Lorsque le droit de rétractation existe, les conditions, le délai et les modalités d'exercice de ce droit ainsi que le formulaire type de rétractation, dont les conditions de présentation et les mentions qu'il contient sont fixées par décret en Conseil d'Etat ;
3° Le cas échéant, le fait que le consommateur supporte les frais de renvoi du bien en cas de rétractation et, pour les contrats à distance, le coût de renvoi du bien lorsque celui-ci, en raison de sa nature, ne peut normalement être renvoyé par la poste ;
4° L'information sur l'obligation du consommateur de payer des frais lorsque celui-ci exerce son droit de rétractation d'un contrat de prestation de services, de distribution d'eau, de fourniture de gaz ou d'électricité et d'abonnement à un réseau de chauffage urbain dont il a demandé expressément l'exécution avant la fin du délai de rétractation ; ces frais sont calculés selon les modalités fixées à l'article L. 221-25 ;
5° Lorsque le droit de rétractation ne peut être exercé en application de l'article L. 221-28, l'information selon laquelle le consommateur ne bénéficie pas de ce droit ou, le cas échéant, les circonstances dans lesquelles le consommateur perd son droit de rétractation ;
6° Les informations relatives aux coordonnées du professionnel, le cas échéant aux coûts de l'utilisation de la technique de communication à distance, à l'existence de codes de bonne conduite, le cas échéant aux cautions et garanties, aux modalités de résiliation, aux modes de règlement des litiges et aux autres conditions contractuelles, dont la liste et le contenu sont fixés par décret en Conseil d'Etat.
Dans le cas d'une vente aux enchères publiques telle que définie par le premier alinéa de l'article L. 321-3 du code de commerce, les informations relatives à l'identité et aux coordonnées postales, téléphoniques et électroniques du professionnel prévues au 4° de l'article L. 111-1 peuvent être remplacées par celles du mandataire.
Article L221-6
Si le professionnel n'a pas respecté ses obligations d'information concernant les frais supplémentaires mentionnés à l'article L. 112-3 et au 3° de l'article L. 221-5, le consommateur n'est pas tenu au paiement de ces frais.
Article L221-7
La charge de la preuve du respect des obligations d'information mentionnées à la présente section pèse sur le professionnel.
Article L221-8
Dans le cas d'un contrat conclu hors établissement, le professionnel fournit au consommateur, sur papier ou, sous réserve de l'accord du consommateur, sur un autre support durable, les informations prévues à l'article L. 221-5.
Ces informations sont rédigées de manière lisible et compréhensible.
Article L221-9
Le professionnel fournit au consommateur un exemplaire daté du contrat conclu hors établissement, sur papier signé par les parties ou, avec l'accord du consommateur, sur un autre support durable, confirmant l'engagement exprès des parties.
Ce contrat comprend toutes les informations prévues à l'article L. 221-5.
Le contrat mentionne, le cas échéant, l'accord exprès du consommateur pour la fourniture d'un contenu numérique indépendant de tout support matériel avant l'expiration du délai de rétractation et, dans cette hypothèse, le renoncement de ce dernier à l'exercice de son droit de rétractation.
Le contrat est accompagné du formulaire type de rétractation mentionné au 2° de l'article L. 221-5.
Article L221-10
Le professionnel ne peut recevoir aucun paiement ou aucune contrepartie, sous quelque forme que ce soit, de la part du consommateur avant l'expiration d'un délai de sept jours à compter de la conclusion du contrat hors établissement.
Toutefois, ne sont pas soumis aux dispositions du premier alinéa :
1° Home subscriptions to daily and similar publications, within the meaning of article 39 bis of the French General Tax Code ;
2° Successive performance contracts, entered into under the conditions set out in this chapter and offered by an approved organization or by decision of the administrative authority, the purpose of which is to provide the services referred to in article L. 7231-1 of the French Labor Code ;
3° Les contrats conclus au cours de réunions organisées par le vendeur à son domicile ou au domicile d'un consommateur ayant préalablement et expressément accepté que cette opération se déroule à son domicile ;
4° Les contrats ayant pour objet des travaux d'entretien ou de réparation à réaliser en urgence au domicile du consommateur et expressément sollicités par lui, dans la limite des pièces de rechange et travaux strictement nécessaires pour répondre à l'urgence.
Pour les contrats mentionnés aux 1° et 2°, le consommateur dispose d'un droit de résiliation du contrat à tout moment et sans préavis, frais ou indemnité et d'un droit au remboursement, dans un délai de quinze jours, des sommes versées au prorata de la durée du contrat restant à courir.
Article L221-11
Lorsque le contrat est conclu à distance, le professionnel fournit au consommateur, de manière lisible et compréhensible, les informations prévues à l'article L. 221-5 ou les met à sa disposition par tout moyen adapté à la technique de communication à distance utilisée.
Article L221-12
Lorsque la technique de communication à distance utilisée impose des limites d'espace ou de temps pour la présentation des informations, le professionnel fournit au consommateur, avant la conclusion du contrat et dans les conditions prévues à l'article L. 221-5, au moins les informations relatives aux caractéristiques essentielles des biens ou des services, à leur prix, à son identité, à la durée du contrat et au droit de rétractation.
Le professionnel transmet au consommateur les autres informations prévues au même article par tout autre moyen adapté à la technique de communication à distance utilisée.
Article L221-13
Le professionnel fournit au consommateur, sur support durable, dans un délai raisonnable, après la conclusion du contrat et au plus tard au moment de la livraison du bien ou avant le début de l'exécution du service, la confirmation du contrat comprenant toutes les informations prévues à l'article L. 221-5, sauf si le professionnel les lui a déjà fournies, sur un support durable, avant la conclusion du contrat. Le contrat est accompagné du formulaire type de rétractation mentionné au 2° du même article.
Le cas échéant, le professionnel fournit au consommateur, dans les mêmes conditions et avant l'expiration du délai de rétractation, la confirmation de son accord exprès pour la fourniture d'un contenu numérique non présenté sur un support matériel et de son renoncement à l'exercice du droit de rétractation.
Article L221-14
Pour les contrats conclus par voie électronique, le professionnel rappelle au consommateur, avant qu'il ne passe sa commande, de manière lisible et compréhensible, les informations relatives aux caractéristiques essentielles des biens ou des services qui font l'objet de la commande, à leur prix, à la durée du contrat et, s'il y a lieu, à la durée minimale des obligations de ce dernier au titre du contrat, tel que prévues à l'article L. 221-5.
Le professionnel veille à ce que le consommateur, lors de sa commande, reconnaisse explicitement son obligation de paiement. À cette fin, la fonction utilisée par le consommateur pour valider sa commande comporte la mention claire et lisible : commande avec obligation de paiement ou une formule analogue, dénuée de toute ambiguïté, indiquant que la passation d'une commande oblige à son paiement.
Les sites de commerce en ligne indiquent clairement et lisiblement, au plus tard au début du processus de commande, les moyens de paiement acceptés par le professionnel et les éventuelles restrictions de livraison.
Article L221-15
Le professionnel est responsable de plein droit à l'égard du consommateur de la bonne exécution des obligations résultant du contrat conclu à distance, que ces obligations soient exécutées par le professionnel qui a conclu ce contrat ou par d'autres prestataires de services, sans préjudice de son droit de recours contre ceux-ci.
Toutefois, il peut s'exonérer de tout ou partie de sa responsabilité en apportant la preuve que l'inexécution ou la mauvaise exécution du contrat est imputable soit au consommateur, soit au fait, imprévisible et insurmontable, d'un tiers au contrat, soit à un cas de force majeure.
Article L221-16
Sans préjudice des dispositions de l'article L. 221-12, le professionnel qui contacte un consommateur par téléphone en vue de conclure un contrat portant sur la vente d'un bien ou sur la fourniture d'un service indique au début de la conversation son identité, le cas échéant l'identité de la personne pour le compte de laquelle il effectue cet appel et la nature commerciale de celui-ci.
À la suite d'un démarchage par téléphone, le professionnel adresse au consommateur, sur papier ou sur support durable, une confirmation de l'offre qu'il a faite et reprenant toutes les informations prévues à l'article L. 221-5.
Le consommateur n'est engagé par cette offre qu'après l'avoir signée et acceptée par écrit ou avoir donné son consentement par voie électronique.
Article L221-17
Lorsqu'un professionnel contacte un consommateur par téléphone dans les conditions prévues à l'article L. 221-16, l'utilisation d'un numéro masqué est interdite.
Le numéro affiché avant l'établissement de l'appel en application du premier alinéa est affecté au professionnel pour le compte duquel l'appel est effectué. En cas de rappel du consommateur à ce numéro, ce professionnel s'identifie préalablement à la facturation de toute prestation de services autre que le prix de la communication.
Un arrêté conjoint des ministres chargés de la consommation et de l'économie numérique, pris après avis de l'Autorité de régulation des communications électroniques et des postes, définit les tranches de numéro qui ne peuvent être utilisées comme identifiant d'appel par un professionnel qui joint un consommateur, en tenant compte du plafond de tarification et du format de ces numéros.
Article L221-18
Le consommateur dispose d'un délai de quatorze jours pour exercer son droit de rétractation d'un contrat conclu à distance, à la suite d'un démarchage téléphonique ou hors établissement, sans avoir à motiver sa décision ni à supporter d'autres coûts que ceux prévus aux articles L. 221-23 à L. 221-25.
Le délai mentionné au premier alinéa court à compter du jour :
1° De la conclusion du contrat, pour les contrats de prestation de services et ceux mentionnés à l'article L. 221-4 ;
2° De la réception du bien par le consommateur ou un tiers, autre que le transporteur, désigné par lui, pour les contrats de vente de biens. Pour les contrats conclus hors établissement, le consommateur peut exercer son droit de rétractation à compter de la conclusion du contrat.
Dans le cas d'une commande portant sur plusieurs biens livrés séparément ou dans le cas d'une commande d'un bien composé de lots ou de pièces multiples dont la livraison est échelonnée sur une période définie, le délai court à compter de la réception du dernier bien ou lot ou de la dernière pièce.
Pour les contrats prévoyant la livraison régulière de biens pendant une période définie, le délai court à compter de la réception du premier bien.
Article L221-19
Conformément au règlement n° 1182/71/ CEE du Conseil du 3 juin 1971 portant détermination des règles applicables aux délais, aux dates et aux termes :
1° The day on which the contract is concluded or the day on which the goods are received is not counted in the period mentioned in article L. 221-18 ;
2° The period begins at the start of the first hour of the first day and ends at the end of the last hour of the last day of the period;
3° If this period expires on a Saturday, Sunday or public holiday, it is extended until the first working day thereafter.
Article L221-20
When information on the right of withdrawal has not been provided to the consumer under the conditions set out in 2° of article L. 221-5, the withdrawal period is extended by twelve months from the expiry of the initial withdrawal period, determined in accordance with article L. 221-18..
However, where the provision of this information occurs during this extension, the withdrawal period expires at the end of a period of fourteen days from the day on which the consumer received this information.
Article L221-21
The consumer exercises his right of withdrawal by informing the trader of his decision to withdraw by sending, before expiry of the period provided for in article L.221-18, of the withdrawal form mentioned in 2° of article L. 221-5 or of any other unambiguous statement expressing the consumer's wish to withdraw.
The trader may also allow the consumer to fill in and submit the form or statement mentioned in the first paragraph on his website. In this case, the trader shall immediately provide the consumer with an acknowledgement of receipt of the withdrawal on a durable medium.
Article L221-22
The burden of proof that the right of withdrawal has been exercised under the conditions set out in article L. 221-21 lies with the consumer.
Article L221-23
Le consommateur renvoie ou restitue les biens au professionnel ou à une personne désignée par ce dernier, sans retard excessif et, au plus tard, dans les quatorze jours suivant la communication de sa décision de se rétracter conformément à l'article L. 221-21, à moins que le professionnel ne propose de récupérer lui-même ces biens.
Le consommateur ne supporte que les coûts directs de renvoi des biens, sauf si le professionnel accepte de les prendre à sa charge ou s'il a omis d'informer le consommateur que ces coûts sont à sa charge. Néanmoins, pour les contrats conclus hors établissement, lorsque les biens sont livrés au domicile du consommateur au moment de la conclusion du contrat, le professionnel récupère les biens à ses frais s'ils ne peuvent pas être renvoyés normalement par voie postale en raison de leur nature.
La responsabilité du consommateur ne peut être engagée qu'en cas de dépréciation des biens résultant de manipulations autres que celles nécessaires pour établir la nature, les caractéristiques et le bon fonctionnement de ces biens, sous réserve que le professionnel ait informé le consommateur de son droit de rétractation, conformément au 2° de l'article L. 221-5.
Article L221-24
Lorsque le droit de rétractation est exercé, le professionnel rembourse le consommateur de la totalité des sommes versées, y compris les frais de livraison, sans retard injustifié et au plus tard dans les quatorze jours à compter de la date à laquelle il est informé de la décision du consommateur de se rétracter. Pour les contrats de vente de biens, à moins qu'il ne propose de récupérer lui-même les biens, le professionnel peut différer le remboursement jusqu'à récupération des biens ou jusqu'à ce que le consommateur ait fourni une preuve de l'expédition de ces biens, la date retenue étant celle du premier de ces faits. Le professionnel effectue ce remboursement en utilisant le même moyen de paiement que celui utilisé par le consommateur pour la transaction initiale, sauf accord exprès du consommateur pour qu'il utilise un autre moyen de paiement et dans la mesure où le remboursement n'occasionne pas de frais pour le consommateur. Le professionnel n'est pas tenu de rembourser les frais supplémentaires si le consommateur a expressément choisi un mode de livraison plus coûteux que le mode de livraison standard proposé par le professionnel.
Article L221-25
Si le consommateur souhaite que l'exécution d'une prestation de services ou d'un contrat mentionné au premier alinéa de l'article L. 221-4 commence avant la fin du délai de rétractation mentionné à l'article L. 221-18, le professionnel recueille sa demande expresse par tout moyen pour les contrats conclus à distance et sur papier ou sur support durable pour les contrats conclus hors établissement. Le consommateur qui a exercé son droit de rétractation d'un contrat de prestation de services ou d'un contrat mentionné au premier alinéa de l'article L. 221-4 dont l'exécution a commencé, à sa demande expresse, avant la fin du délai de rétractation verse au professionnel un montant correspondant au service fourni jusqu'à la communication de sa décision de se rétracter ; ce montant est proportionné au prix total de la prestation convenu dans le contrat. Si le prix total est excessif, le montant approprié est calculé sur la base de la valeur marchande de ce qui a été fourni. Aucune somme n'est due par le consommateur ayant exercé son droit de rétractation si sa demande expresse n'a pas été recueillie en application du premier alinéa ou si le professionnel n'a pas respecté l'obligation d'information prévue au 4° de l'article L. 221-5.
Article L221-26
Le consommateur qui a exercé son droit de rétractation d'un contrat de fourniture de contenu numérique non fourni sur un support matériel n'est redevable d'aucune somme si : 1° Le professionnel n'a pas recueilli son accord préalable exprès pour l'exécution du contrat avant la fin du délai de rétractation ainsi que la preuve de son renoncement à son droit de rétractation ; 2° Le contrat ne reprend pas les mentions prévues au troisième alinéa de l'article L. 221-9 et au second alinéa de l'article L. 221-13.
Article L221-27
L'exercice du droit de rétractation met fin à l'obligation des parties soit d'exécuter le contrat à distance ou le contrat hors établissement, soit de le conclure lorsque le consommateur a fait une offre. L'exercice du droit de rétractation d'un contrat principal à distance ou hors établissement met automatiquement fin à tout contrat accessoire, sans frais pour le consommateur autres que ceux prévus aux articles L. 221-23 à L. 221-25.
Article L221-28
Le droit de rétractation ne peut être exercé pour les contrats :
1° Supply of services fully performed before the end of the withdrawal period and whose performance has begun after the consumer's express prior agreement and express waiver of his right of withdrawal;
2° The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period;
3° The supply of goods made to the consumer's specifications or clearly personalized; 4° The supply of goods likely to deteriorate or expire rapidly;
5° Supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
6° The supply of goods which, after delivery and by their nature, are inseparably mixed with other articles;
7° The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations in the market beyond the control of the trader;
8° Maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by the consumer, within the limit of spare parts and work strictly necessary to respond to the emergency;
9° Supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;
10° Supply of a newspaper, periodical or magazine, except for subscription contracts for these publications;
11° Concluded at a public auction ;
12° Accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which must be provided on a specific date or at a specific time;
13° The supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal.
PROVISIONS OF THE CONSUMER CODE AND CIVIL CODE RELATING TO LEGAL WARRANTIES
Article L217-4 of the French Consumer Code
The seller is obliged to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility.
Article L217-5 of the French Consumer Code
To conform to the contract, the good must :
  • Be fit for the purpose ordinarily expected of similar goods and, where applicable: correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model Have the qualities that a buyer may legitimately expect having regard to public statements made by the seller, the producer or his representative, in particular in advertising or labelling
  • Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L217-12 of the French Consumer Code
The action resulting from a lack of conformity is time-barred two years after delivery of the goods.
Article L217-16 of the French Consumer Code
When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the buyer's request for service or from the date the item in question is made available for repair, if the item is made available after the request for service.
Article 1641 of the French Civil Code
The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.
Article 1648 paragraph 1 of the French Civil Code
The buyer must bring an action for redhibitory defects within two years of discovery of the defect.
